1. Agreement to These Terms
These Terms of Service ("Terms") form a binding agreement between you and DiffLab Co., Limited ("we", "us", "our") governing your access to and use of the FindKol website, applications and related services (the "Service").
By creating an account, connecting an email channel, or otherwise using the Service, you accept these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
We may update these Terms from time to time. For material changes we will give notice in the Service or by email at least fourteen (14) days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
2. The Service
FindKol is business software for cross-border e-commerce teams. It lets you: discover publicly available social-media creator profiles; analyse public metrics and statistical audience estimates; manage creator relationships and collaborations; attribute conversions (e.g. via discount codes); and send outreach email through email channels that you connect and control.
Creator data shown in the Service is derived from publicly accessible sources, aggregated through third-party data providers and, where available, platform panel data. Audience characteristics (country, language, age composition) are statistical estimates, not verified facts.
FindKol is an independent tool. We are not affiliated with, endorsed by or sponsored by TikTok, Instagram, YouTube, X, Xiaohongshu, Douyin or any other platform, and data availability depends on those platforms and our providers.
The Service is a business tool. It is not a "consumer reporting agency" and does not provide consumer reports. You may not use creator data to make decisions about employment, credit, insurance eligibility or any other purpose governed by consumer-reporting laws.
3. Eligibility and Accounts
You must be at least 18 years old and legally able to enter into contracts to use the Service.
You agree to provide accurate account information, keep your credentials confidential, and remain responsible for all activity under your account — including activity by team members you invite. You are responsible for assigning appropriate roles and removing members who should no longer have access.
An account is for one customer entity or individual. You may not share credentials between multiple unrelated parties.
4. Subscriptions, Credits and Billing
Paid plans and credit packs are billed through our payment processor, Stripe. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from the Billing page; cancellation takes effect at the end of the current period, and you keep access until then.
Certain actions consume credits — for example, contact unlocks, deep creator reports and AI features. Contact unlocks are charged only when a result is found; report tasks that fail are automatically refunded. Unless required by law or expressly stated otherwise, subscription fees and consumed credits are non-refundable.
Prices are stated exclusive of taxes unless otherwise indicated. You are responsible for applicable taxes and for the lawfulness of the payment method you use.
5. Acceptable Use and Outreach Compliance
You are solely responsible for the lawfulness of the outreach messages you send through the Service. You must comply with all applicable anti-spam and electronic-marketing laws — including the U.S. CAN-SPAM Act, Canada's CASL, the EU/EEA GDPR and ePrivacy rules, and their local equivalents — which generally require: truthful sender identities and subject lines; a valid physical address and unsubscribe mechanism where required; and prompt honoring of opt-out requests.
The Service helps you respect creator choices: creators who reply with an unsubscribe or opt-out request are automatically blocked from further outreach, and creators you block can no longer be contacted. You must not attempt to circumvent these protections.
You must not use the Service to: send unlawful, harassing, deceptive or misleading messages; send unsolicited bulk messages beyond the limits configured in the Service; build profiles or make automated decisions about individuals in violation of applicable law; scrape, reverse-engineer, resell or place excessive load on the Service; breach third-party platform terms; send email through a channel you are not authorized to use; or misrepresent your identity or your relationship with us.
6. Creator Data and Data Sources
Creator profiles, metrics and audience characteristics in the Service come from publicly accessible sources, aggregated through third-party data providers and, where available, platform panel data. We cache this data alongside its source, do not resell providers' raw output, and present processed distributions and estimates in the product.
Public data may be incomplete, outdated or wrong. Follower counts, engagement rates, view counts and audience composition are estimates and may be inaccurate. You should verify information independently before making commercial decisions.
Upstream data availability depends on platforms and providers. Fields may change, degrade or become unavailable without notice, and we are not liable for such changes.
7. AI-Assisted Features
Some features use third-party large language models — for example, parsing natural-language search, drafting outreach messages, or summarizing reports.
AI output is generated automatically and may be inaccurate, incomplete, outdated or unsuitable for your purpose. You must review AI-generated content before relying on it or sending it.
You are responsible for messages and decisions produced with AI assistance. Inputs you provide are processed to generate outputs as described in the Privacy Policy.
8. Integrations (Email and Shopify)
Email channels: connecting a Gmail or Outlook mailbox grants only the permissions needed to send outreach you approve and to read replies to conversations sent through the Service. Access tokens are stored encrypted. You warrant that you are authorized to connect that mailbox.
Shopify: if you connect a store, you warrant that you are the merchant or an authorized user of the store. Order and discount-code data is processed solely to attribute conversions to creator collaborations and is not used for other purposes.
9. Your Content; Our Intellectual Property
You retain all rights to content you create or upload — lists, notes, collaborations, discount codes, email templates and messages ("Your Content"). You grant us a limited, non-exclusive license to host and process Your Content solely to operate and support the Service.
The Service itself — software, design, text and branding — is owned by us or our licensors. We grant you a non-exclusive, non-transferable right to use the Service in accordance with these Terms; no other rights are transferred.
Platform names and trademarks (TikTok, Instagram, YouTube, X, Xiaohongshu, Douyin and others) belong to their respective owners.
10. Privacy and Security
Our Privacy Policy describes how we collect, use and protect personal data, and is part of these Terms.
We apply technical and organizational security measures — including TLS in transit, AES-256-GCM encryption for stored integration tokens and hashed passwords, and least-privilege access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Business customers that require a data processing agreement (DPA) may request one from us using the contact details below.
11. Suspension and Termination
You may stop using the Service and cancel your subscription at any time. You can export your workspace data from within the Service.
We may suspend or terminate access where reasonably necessary — for example, material breach of these Terms, non-payment, unlawful use, or legal risk — with notice where practicable.
After termination, your account ceases and workspace data is handled in accordance with the Privacy Policy. You may request an export of Your Content within thirty (30) days of termination.
12. Disclaimers
Except as expressly stated, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied — including warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that creator data, metrics, estimates or AI output are accurate, complete or up to date, that the Service will be uninterrupted or error-free, or that defects will be corrected. You rely on the Service at your own discretion.
13. Limitation of Liability; Indemnification
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill.
Nothing in these Terms limits liability that cannot be limited by law — such as liability for gross negligence, willful misconduct, or statutory consumer rights.
You will indemnify and hold us harmless against third-party claims arising from your outreach messages, your use of creator data, your breach of these Terms or applicable law, or disputes between you and creators.
14. Governing Law, Changes and Contact
These Terms are governed by the laws of Hong Kong, excluding its conflict-of-laws rules. Before filing a claim, the parties will attempt to resolve any dispute informally for thirty (30) days. Subject to that, disputes shall be brought in the courts of Hong Kong, unless mandatory consumer-protection law provides otherwise.
We may change the Service — for example, add or discontinue features. Material reductions to paid functionality will be announced in advance where practicable.
